NORTH OLMSTED, Ohio ? Mayor Kevin Kennedy is filing a complaint with the Ohio Elections Commission against Thomas O?Grady, a former mayor and current candidate for mayor.
The complaint is outlined in a letter and affidavit from Kennedy dated Oct. 4. The documents are visible at the bottom of this story.
O?Grady said he believed the complaint was unfounded.
Kennedy and O?Grady are challenging each other on the November ballot for the mayor?s office.
Kennedy?s complaint with the Elections Commission states that O?Grady on his political signs refers to himself as ?mayor.? The signs read: ?Leadership for North Olmsted Mayor Thomas O?Grady.?
?Thomas O?Grady is not the mayor of the city of North Olmsted, Ohio, or any other city,? Kennedy said in his affidavit.
He then cited a section of the Ohio Revised Code that says no candidate for public office should knowingly and with intent to affect the outcome of a campaign ?use the title of an office not currently held by a candidate in a manner that implies the candidate does currently hold that office??
?This is just the latest in a string of unfortunate actions by O?Grady that have left me shaking my head in disbelief,? Kennedy said.
Kennedy said it appears O?Grady wants to confuse people, causing them to believe that he?s the mayor when he lost that title four years ago.
However, O?Grady said he believes his actions were appropriate.
?Once you have earned the office of any chief executive officer, president, governor, mayor, you?re always entitled to that title,? O?Grady said. "I figured if I?m doing this, I might as well get signs that I can use after the election as well.?
O?Grady said he believed the complaint was a ploy by Kennedy to distract voters from other issues.
?If we?re doing something wrong, we will correct it immediately, but I don?t buy this,? O?Grady said.
O'Grady recently was involved in another controversy involving a Kennedy campaign sign in a neighbor's yard.
Officials with the Ohio Elections Commission could not be reached for comment.
